Publishing Services Terms

These Publishing Services Terms outline the conditions under which NewSky Publishing ("Company," "we," "us," or "our") provides publishing, editorial, design, and related services to authors, clients, and partners.

By engaging our services, you agree to the terms described below, as well as any additional agreements or proposals provided for specific projects.

1. Scope of Services

NewSky Publishing offers a range of services, which may include editing, formatting, cover design, publishing support, distribution setup, and related services. The specific scope of services will be defined in a separate agreement, proposal, or service package.

We reserve the right to modify, expand, or limit service offerings at our discretion.

2. Service Delivery

We will make reasonable efforts to deliver services in a timely and professional manner. However, timelines are estimates and may vary based on project complexity, client responsiveness, and other factors.

We are not responsible for delays caused by incomplete submissions, client revisions, or third-party dependencies.

3. Client Responsibilities

Clients are responsible for providing accurate, complete, and timely materials required for service delivery. This includes manuscripts, images, instructions, and approvals.

Clients must review and approve deliverables in a timely manner. Delays in communication may affect project timelines.

4. Payments and Fees

All services are subject to agreed-upon fees. Payment terms, including deposits and final payments, will be outlined in a separate agreement or invoice.

Failure to make timely payments may result in suspension or termination of services.

5. Revisions and Changes

Service packages may include a limited number of revisions. Additional revisions or changes beyond the agreed scope may incur additional fees.

We reserve the right to determine what constitutes a revision versus a new request.

6. No Guarantee of Results

We do not guarantee publication success, sales performance, distribution reach, or financial outcomes. Results may vary based on external factors beyond our control.

7. Third-Party Platforms

Our services may involve third-party platforms such as online retailers, distribution services, or publishing tools. We are not responsible for the policies, performance, or decisions of third-party platforms.

Acceptance, listing, or distribution of content is subject to third-party requirements.

8. Intellectual Property

Ownership of intellectual property will be defined in a separate agreement. Unless otherwise stated, authors retain ownership of their work.

By engaging our services, you grant us the right to use submitted materials for the purpose of delivering agreed services.

9. Termination

We reserve the right to terminate services at any time for non-payment, violation of terms, or other valid reasons. Clients may also terminate services in accordance with the terms of their agreement.

Upon termination, fees for completed work remain payable.

10. Limitation of Liability

To the fullest extent permitted by law, NewSky Publishing shall not be liable for any damages arising from service delivery, delays, third-party platforms, or outcomes related to published works.

This includes, but is not limited to, loss of revenue, opportunity, or business performance.

11. Indemnification

Clients agree to indemnify and hold harmless NewSky Publishing from any claims, damages, or liabilities arising from submitted materials, including intellectual property disputes.

12. Governing Law

These Publishing Services Terms shall be governed and interpreted in accordance with the laws of the State of New York, without regard to conflict of law principles.
